When can I get divorced?

You can apply to the court for a divorce after you have been married for one year.

How long does the divorce process take?

If the divorce is not contested or if there are no finance or children matters to deal with a divorce should take between 4 and 6 months depending on the speed at which your ex-spouse returns the relevant forms.

Can I rely on my spouses adultery even if we are seperated?

Yes as long as you haven’t reconciled following the adultery for a period of more than 6 months.

Will I have to go to court?

Usually if a divorce is not contested then the whole process can be completed as a paper exercise. Going to court is normally only involved if an agreement cannot be reached between the parties.

What are the grounds for Divorce?

There is only one ground for divorce, that your marriage has broken done irreparably. You must however prove this by showing one of the 5 facts normally. That your spouse has committed adultery, that your spouse has behaved unreasonably, that you have been separated for 2 years and your spouse consents to the divorce, that your spouse has deserted you for 2 years or that you have been separated for 5 years.
